Han Geng’s termination request document revealed

We previously reported that Han Geng of Super Junior filed a lawsuit in order to void his contract with SM Entertainment. The written accusation submitted argues that his contract with SME is unfair due to 6 reasons.

First, the accusation argues that SME was the dominant party in signing of the contract and thus it was written in their favor. When the contract was first signed in January 2003, Hankyung was only 17 years old and he did not have sufficient information on the Korean entertainment industry. Two updates made to the contract in February and December of 2007 were also led by SME and Han Geng had no choice but to accept what was offered by SME.

Second, the length of the contract is 13 years. When the contract was first signed, it was to last for 10 years after the release of Super Junior's first album. After the two updates, the length was extended to 13 years. The contract would last at least until December 2018, when Han Geng would become 34 years old. The contract extends automatically when Han Geng takes break for personal reasons, so the actual length could be much longer than 13 years. The accusation calls this a great invasion of Han Geng's basic human rights.

Third, the contract enforces heavy financial punishment in case of a breach of contract, preventing Han Geng from seeking release. If Han Geng was to breach the contract and move to another entertainment company, he has to compensate SME for 3 times what they invested in him and double what he would have earned for SME during remaining period of the contract. The accusation argues that this makes it impossible for Han Geng to leave SME.

Fourth, the terms on rights and division of responsibilities are unfair towards Han Geng. SME is responsible for vague tasks such as "management of the artist's popularity" and natural tasks such as "notifying the artist of new schedules". On the other hand, Han Geng is to follow SME's decisions without question and without having any rights for adjustment of the contract, making the contract unfair for Han Geng, according to the accusation.

Fifth, the contract made Han Geng overwork. He was forced to pay $10 during his training period for his first offense of being late, being absent, disobedience etc. and $20 per offense after. When he could not be contacted for more than a day, SME was given the right to null their contract. After his debut as a member of Super Junior, if his disobedience resulted in damage of less than $5,000 to SME then he was to compensate $5000; if the damage exceeded that amount then he was required to compensate for whatever the damage he caused. He had no right to present his opinion on any matter, and was forced to follow SME's instructions at all times. The accusation says that Han Geng has lost his confidence due to these reasons.

Due to the fifth reason, Han Geng has not been able to rest for a sufficient amount of time since Super Junior's debut. The accusation argues that he hasn't had a break for last 2 years due to his busy schedule. Because the contract enforces heavy financial punishment and automatic extension of the contract length, he had to continue performing in poor health. According to his representatives he suffers from gastritis and kidney problems resulting from high stress, as well as back pain and exhaustion. He frequently asked for a break due to medical reasons but they were all turned down, the accusation claims.

Sixth, he was not given proper rights regarding profit and products of his performance. Rights to all songs and albums belong to SME, even if the song was written by the artist. Profit division was favored towards SME; in case of albums, Super Junior received 2% of the revenue only if the album sold more than 50,000 copies, for digital sales they received 10% of the net profit; for revenue from overseas they were given 60% of net profit. Album sales meant nothing to the artists as 2% of the revenue was divided among 13 members. Digital sales and foreign income were given to artists only when profit was made, allowing SME free from risk of losing money, according to the accusation.

The written accusation against SME argues that due to these 6 reasons, the contract should be voided and Han Geng should be released from his obligations for SME.

Alam po namin na mejo hndi maganda ang details, regarding the number of members that will be able to participate. Kung kaming Admins lang ang tatanungin at masusunod, syempre gusto namin na lahat TAYO, KAYO, ay makapunta at makita si Kim Joon. But as I have posted, sumusunod lang po kami sa instructions na ibinibigay sa amin. Ang totoo niyan, when we were asked at first kung ilang members (or fans) ang estimated namin na pupunta, we said it would be about 200, or more, but still we asked if they have set a limit to the number of people that can participate. Sabi nila sa next e-mail nila, they can give us 100 slots.. but then, another e-mail came in, stating that they are very sorry, but they can only give us those 55 slots (do we need to show you the screen caps of that e-mail para po may proof kami...?). Humirit pa kami na kung pedeng madagdagan un, pero hndi n daw talaga pwede.

And about the "exclusivity" of this event to BOF Ph, here is MY statement for that:
-->Group 8 contacted BOF Ph, and of course, we prioritize our members for this event. Kung dun lang sa 55 slots na un, kulang na kulang po for the BOF Ph members. Kahit ano naman pong organization, na may opportunity like this, uunahin talaga ang members nila. Alam naman po namin na marami talagang gustong pumunta, kahit na hindi members ng org na ito... kung kami lang ang masusunod,why not di po ba...? Sana po, maintindihan ninyo na hindi kami nagdadamot. It's just that, 55 slots lang po talaga ang ibinigay sa amin ng mga organizers. Huwag po sana tayong mag-away away just because of this. Malay natin, kung makakabalik sila dito, mas malaking number of audience ang ibigay nila (but we are not saying na kami pa rin ang kokontakin nila... ) I know that we are all doing this for the love of our idol. LOVE & PEACE.

We want everyone here to know and to UNDERSTAND na hindi po kami ang kumontak sa Group 8. Ang tibay naman namin king kami pa ang magrerequest sa kanila na papuntahin dito si Joon,di ba..? Sila po ang UNANG kumontak sa amin. We really have no idea how they found out about our group, even the e-mail address of our Admin/President Bryan. Kahit po kami, nagulat din. Hindi po ako galit. Nagpapaliwanag lang, because I have been hearing comments about this issue, from members na nirerelay sa akin ung mga nabasa nila somewhere; but I haven't seen any of those myself.

i don't know, at first they put the place it's Hyatt Hotel.. then suddenly, they said it might change. coz the 'news' about kim joon's arrival was already in the net, allkpop, newsen, etc. then they decided to erase the location.

until the day the list came out, as expected i wasn't there. then came the news that there will be 2 parts for kim joon - awarding in the morning and fan signing in the afternoon. before this, kim joon was reported positive for swine flu.

28th of nov. came, said that the event will still pursue.. but the following day, someone text me these words - EVENT CANCELLED.

last Saturday, 11/21, we received a very exciting news that Kim Joon of T-Max will be here for the Korean-Filipino Festival this November. He'll have an interview at 'The Buzz' and a fan signing event after.

This certain fan forum claims the exclusivity of the event because they said that they were contacted by this Korean production company. BUT, they kept on posting announcements on every fan forum they can.

GROUP8 gave us a limitation for the slots.
which is diff. from the first email caps that we posted already on th teaser announcment
